Computer Software Piracy - Computers - Software

Computer Software Piracy and it's Impact on the International Economy The PC industry is over twenty years old. In those twenty years, evolving softwaretechnology brings us faster, more sophisticated, versatile and easy-to-use products.Business software allows companies to save time, effort and money.

Educationalcomputer programs teach basic skills and complicated subjects. Home software nowincludes a wide variety of programs that enhance the users productivity and creativity. The industry is thriving and users stand to benefit along with the publishers. The SPA(Software Publishers Association) reports that the problem of software theft has grown, and threatens to prevent the development of new software products. Unauthorizedduplication of software is known as software piracy which is a "Federal offense thataffects everyone" ("Software Use..." Internet).

The following research examinessoftware piracy in its various forms, its impact on the end user and the internationalindus try as a whole, and the progress that has been made in alleviating the problem. Software piracy harms all software companies and ultimately, the end user. Piracyresults in higher prices for honest users, reduced levels of support and delays in fundingand development of new products, causing the overall breadth and quality of software tosuffer" ("What is..." Internet). Even the users of unlawful copies suffer from their ownillegal actions: they receive no documentation, no customer support and no informationabout product updates ("Software Use..." Internet). The White Paper says that while virtually every software publisher expressesconcern about their software from unauthorized duplication, over time, many havesimply accepted the so-called "fact" that such duplication is unavoidable.

This hascreated an atmosphere in which software piracy is commonly accepted as "just anothercost of doing business" ("With the Growth..." Internet). In a brochure published by the SPA it is s tated that a major problem arises fromthe fact that most people do not even know they are breaking the law. "Because thesoftware industry is relatively new, and because copying software is so easy, many peopleare either unaware of the laws governing software use or choose to ignore them" ("ToCopy or not to Copy" Internet). Robert Perry states that much of the problem of software theft arises from the waythe software industry developed. In the past, when a software firm spent millions ofdollars to write a program for a mainframe computer, it knew it would sell a handful ofcopies. It licensed each copy to protect its ownership rights and control the use of eachcopy.

That is easy to do with only a few copies of a program. It is impossible for asoftware company to handle five million copies of there latest program (27). Software piracy is defined as any violations of software license agreements. In1964, the United States Copyright Office began to register software as a form of literaryexpression. The Copyright Act, title 17 of the U.S. Code, was amended in 1980 toexplicitly include computer programs. Today, according to the Copyright Act, it is illegalto make or distribute copyrighted material without authorization, the only exceptions arethe user's right to make as an "essential step" in using the program (for example, bycopying the program into RAM or on the hard drive) and to make a single backup copyfor "archival purposes."

No other copies may be made without specific authorizationfrom the copyright owner (title 17 section 117). A SPA press release shows that in December 1990, the U.S. Congress approvedthe Software Rental Amendments Act, which generally prohibits the rental, leasing orlending of software with out the express written permission of the copyright holder("Retailers Agree..." Internet). "It doesn't mater whether the transaction is called 'rental,'buy-back,' 'try before you buy,' preview,' 'evaluation' or any similar term. If theso ftware dealer does not have written permission from the copyright holders to rentsoftware, it is illegal to do so." said Sandra Sellers, SPA vice president of intellectualproperty education and enforcement ("SPA sues..." Internet.") NERDC information services researched that the copyright holder may grantadditional rights at the time the personal computer software is acquired.

For example, many applications are sold in LAN (local area network) versions that allow a softwarepackage to be placed on a LAN for access by multiple users. Additionally, permission isgiven under special license agreement to make multiple copies for use throughout a largeorganization. However unless these rights are specifically granted, U.S. law prohibits auser from making duplicate copies of software except to ensure one working copy andone archival copy (NERDC Internet). Without authorization from the copyright owner, title 18 of U.S. Code prohibitsduplicating software for profit, making multiple c opies for use by different users withinan organization, downloading multiple copies from a network, or giving an unauthorizedcopy to another individual.

All are illegal and a federal crime. Penalties include fines upto $250, 000 and jail terms up to five years (Title 18, Section 2320 and 2322). Microsoft states that illegal copying of personal computer software is a crucialdilemma both in the United States and over seas. Piracy is widely practiced and widelytolerated, in some countries, legal protection for software is non existent; in others lawsare unclear, or not enforced with sufficient commitment. Significant piracy losses aresuffered in virtually ever region of the world. In Some cases, like Indonesia, the rate ofunauthorized copies is believed to be in excess of ninety-nine percent ("What is..."Internet).

Copyright laws vary widely from country to country, as do interpretations of thelaws and the degree to which they are enforced. The concept of protecting the intelle ctualproperty incorporated in software is not universally recognized. Asia is one of the most technologically advanced regions of the world. As thesoftware market continues to grow and flourish so does the black market of softwarepiracy ("The Impact..." Internet). The worst countries in this area are China and Russia.Named "one copy countries" two years in a row (1995 and 1996) by the SPA, studiesshow that ninety-five to ninety-eight percent, virtually every copy, of U.S. businesssoftware is illegally pirated, which costs U.S. software companies an estimated five-hundred million dollars a year ("SPA names..." Internet and "U.S., China..." D1 - 2).

InRussia the latest statistics from the SPA show that ninety-five percent of businesssoftware is illegally copied, that cost the U.S. $117 million in 1994 ("SPA names..."Internet). Although Asia has extremely high piracy rates, SPA Executive Director KenWasch comments "China, Russia, and Thailand (the three countries in Asia with thehighest piracy rates) deserve credit for enacting copyright laws that specifically protectcomputer programs and other software..." Russia and China enacted copyright protectionstatutes several years ago, and Thailand enacted its law late in 1994 ("SPA names..."Internet).

Asian countries have also taken action against offenders of copyright laws. TheSPA reports that "on Wednesday, May 22, 1996, Hong Kong Customs officers arrestedtwo suspected software pirate vendors and seized 20 CD-ROMs, each containingsoftware with an estimated total retail value of US$20,000 along with the equipmentcapable of reproducing the pirate CDs" ("Hong Kong..." Internet). A Software PublishersAssociation press release shows more examples of Asia's fight against software piracywhen Singapore police raided vans carrying 5,800 CD-ROMs containing $700,000 U.S.dollars worth of pirated software on March 25, 1996 ("SPA, Singapore..." Internet).

TheBloomberg forum reports that on August 7, 1995 China a nti-piracy forces invaded storesin the southwestern city of Chengdu and arrested 37 people. The Business SoftwareAlliance's "vice president Stephanie Mitchell said while that was the largest number ofpeople so far arrested in a single raid on software retailers, China must dish out harderpunishments to discourage pirates after their caught" ("China takes..." Internet). A result of China's lack of strictness, the SPA called upon the USTR (U.S. TradeRepresentative) "...to take action against China under Section 306 of the Trade Act of1974 for failing to improve enforcement of intellectual property right in computersoftware."

Also Russia and Korea were placed on the Special 301 Priority Watch List bythe USTR so that the SPA is able to review their intellectual property laws andenforcement ("China and Russia..." Internet). "The United States and China signed amajor accord in March of 1996 mandating tough enforcement against intellectualproperty piracy in China..."(Parker np). The BSA's European anti-piracy program is comprised of over 20 countriesthrough out the region and was initiated in 1989 "...with the filing of the softwareindustry's first enforcement action for the illegal use of software in Italy". Piracycontinues to be a significant problem in spite of the enactment of stronger copyright lawsand successful prosecutions against software theft.

"The average piracy rates of 25European countries was estimated at 58 percent in 1994, with dollar losses exceeding $6billion" ("The Impact..." Internet). Microsoft's studies show that many European countries including some whichoffer computer software protection, have "unreasonably burdensome" administrativerules. Poland and the United Kingdom have displayed difficulty in collecting evidenceand Greece is blamed for "fragmentation of court process." Most European countries donot have sufficient penalties and inadequate civil enforcement possibilities to discouragepiracy, especially Germany, Poland, Sweden and the UK.

"Several countries, forexample, Belarus and Romania, have general copyright laws that protect literaryexpression, but fail to clearly protect computer software" ("What is.." Internet). Irelandis Europe's worst offender with yearly losses of more then forty-four million dollars peryear due to the fact that eighty-three percent of software is pirated ("Software Piracy:Ireland..." Internet). The BSA "called for legislative reform and stricter observance of laws" afterreviewing a study examining Europe's software piracy rates. The BSA argues that"experience has shown that improved legal protection for software copyright, and betterpolicing by private companies and governments, can lead to a significant reduction in thenumber of illegal copies being made" ("Software Piracy: Ireland..." Internet).

Latin America is the second fastest growing market for package software ("TheImpact..." Internet). SPA president Ken Wasch said, "The encouraging first quarters sales data (1995) confirms Brazil's status as a major market for U.S. software publishers. Witha rapidly growing and increasing sophisticated economy. The potential for U.S. softwarecompanies in Brazil is enormous" ("Latin America..." Internet). Gowning along with theincrease of sales and production is the threat of software theft "with the average piracyrate in 16 countries estimated at seventy-eight percent in 1994" ("The Impact..." Internet).

The effect of international piracy organizations is a major problem that everyoneis aware of. Another element which is beginging to make its presence known is the small-time software pirates that distribute software on BBSs (Bulletin Board Systems) or overthe Internet. As with most topics dealing with the extremely new Internet undergroundand Internet crimes, it is very difficult to obtain information on these subjects. In order toacquire information about these underground Internet crimes, which are important tofully understand the conce pt of software piracy, most of the subject matter is supplied bymy own personal observations and investigations.

Most small-time software piracy centers around bulletin board systems thatspecialize in "warez" (common underground term for pirated software). On thesesystems, pirates can contribute and share copies of commercial software. Having accessto these systems (usually obtained by contributing copyrighted programs via telephonemodem or money donations) allows the pirate to copy, or "download," copyrightedsoftware. All the participants benefit because individuals must "upload" (copy files fromtheir system to the BBS) copyrighted programs in order to download.

This way newprograms are appearing continuously. My observation reveals how pirates have found ways to become more efficient bycreating mutual participation "pirate groups" (as referred to by the computerunderground). These groups are composed of ten to seventy members contributing indifferent ways. The members usua lly are anywhere from thirteen to thirty years of age. Some pirate groups are international, with members operating from different regions ofthe world. Their primary purpose is to obtain the latest software, remove any copy-protection from it and then distribute it to the pirate community.

The methods the piratesuse to obtain the software is only known by the members of the pirate groups themselves. Some speculate that the members either "hack" (break into a computer via modem fromone's own system) into computers of software companies and steal the software or "payoff" employees of software companies. The software they receive is almost always lessthen one day old and is often referred to as a "zero day ware." "The Internet is an incredible international electronic information systemproviding millions with access to education, entertainment. and business resources, aswell as promoting new forms of personal communication, including e-mail and on-linechatting" (Larson Internet) . This also creates ideal piracy breeding grounds. Softwarepirates utilize the services of the Internet to "trade" copyrighted

The software expect Chinese software - Business - Small Business

With the strength of the national software, the government authority to strengthen the inspection of the original software rectification work is also about the accomplished. According to the national copyright administration news, by May 31, the whole state of the state organs at the central completed on time and good quality, the original software rectification, including purchasing check the proportion of foreign software reached 62%, nearly two times of domestic software, and in procurement value, the amount of foreign software even accounted for more than 82% of the total amount of purchase.

Data shows that although in government procurement, the number of domestic software some improved, but compared with foreign software, the disadvantages are still the same. This can't help letting person generation doubt: in government procurement, why not so popular domestic software? What are they? Domestic software spring how far?

Government procurement preference for foreign software

By the end of last year the news had let the person seething, that is, the state council issued a "on further to complete the government agencies use original software notice" and "about the need to use original software special inspection and centralized purchasing the notice on the way. "Notice" points out, the government institutions at various levels should take the lead in using the original software. Soon the about the need to use original software special inspection and centralized purchasing the notice on the way, the requirement of the state organs at the central and local state organs respectively in 2011 before the end of may and before the end of October, the complete software the original special inspection and repair work.

The personage inside course of study points out, the original storm will probably gave birth to domestic software the new opportunity. But the results clearly a disappointing.

According to the national copyright administration news, by May 31, 135 the state organs at the central home on time, quality and comprehensive completed the inspection of the original software rectification work, a total of 176763 sets of purchase genuine software (license), purchase amount is 140.91 million yuan, including purchasing domestic software 66511 sets, purchase amount of 24.88 million yuan, purchasing foreign software 110252 sets, purchase amount of 116.03 million yuan. Set up the software asset management system, and gradually form the original software long-acting mechanism.

Reporters calculated that in national office software original software procurement, the number of domestic software accounted for 38% of purchasing foreign software ratio is occupied 62%, is nearly two times of domestic software, and in procurement value, the amount of foreign software even accounted for more than 82% of the total amount of purchase, relatively speaking, domestic software procurement value of less than 18%. This obviously distance before the industry forecast the new opportunity is still some distance.

In government procurement, foreign software seems to continue to get the favour of the government procurement. According to information, government procurement software including the operating system, office software and antivirus software three categories. The personage inside course of study revealed that in government procurement office software and antivirus software, domestic software occupied into certain share, but in the operating system, Microsoft's share even account for more than 90%.
Why is the government procurement preference foreign software "is so foreign software the first impression of reason." Departments under the CPC central committee the relevant person in charge of purchasing center told reporters.

This view by many people get the approval. Jinshan software company marketing manager PengYaLi said, was Microsoft as foreign enterprises, such as in government procurement occupied larger market share, because it started in cultivating markets early, when people use has first impressions are most lasting. At the same time, from the 1990 s, learn university education network are based on examination of Microsoft's operating system and office software, and to a certain extent the use of training people habit.

And for one of the company's software in total, says that this with some foreign software on the counsel. Microsoft, for example, to open the Chinese market in the process of the existence of piracy, tacitly, with a large number of piracy foster market, and gradually achieve monopoly situation. "There are 80% of the users in the use of piracy, leaving the software Microsoft domestic space is very small."

But there are people who don't agree with this view. The Internet, the senior experts think buting foreign software in government procurement in occupy a large share, because the Chinese government department of information, network degree of relatively low. At the same time, the software of the government procurement, the main is general use of the software, and some of the fundamentals of domestic production, specificity strong software, is mostly not in government procurement range.

Domestic software problem

Although in government procurement in China software as foreign software, but share in actual process, the domestic software is not certain foreign software?

"Domestic and foreign software in use software on gaps, and, to some extent, the domestic software even more than the foreign software." Jinshan software company a old total says. He says that, although foreign software such as Microsoft office software in operating system and started really on the country than in early, and users in the habit has great advantage, but technically, domestic office software and abroad, while domestic gaps than software have their own advantages, such as price: the government procurement of Microsoft office software than jinshan W PS office software on a few times, and your jinshan W PS personal edition has all free, price is high. And he said, the domestic software has no foreign software localization of service and personalized service, and may, according to needs of different users need not special customized and service.

And in the software for people to say, from the function for domestic use, the software such as ever with Microsoft office in gaps, basic office demand can be satisfied.
Ever with the software before the close relationship and science and technology. In science and technology and founded in 2000, had been a domestic software industry, and with the best in ffice O software outspoken. With the government office software, and the opportunities of the original of the science and technology in government procurement projects, the frequently.

Data shows, in 2004 the government procurement, and science and technology in the 21 provinces and cities, occupied the annual provincial government procurement in addition to the highest share of Microsoft. In 2005 the year of the prefecture government procurement and 40, in the number of more than 40%, and the entire cities in purchasing also more than Microsoft's share of the domestic first occupied. However, did not last long. As the government procurement projects, ever decreasing year by year in the science and technology business performance fell sharply. From 2005 in to $20.71 million down to 2009 i n the first three quarters of more th
an 200 yuan of the sales.

In the science and technology "and" time away, put away the public outcry enterprise's management difficult position and interests of its bankruptcy, and strife, and divisions, the reason is also the debate, it is thought that, for lack of competitiveness in science and technology, at the beginning of success is the result of the government to support, when there is no government support, the bankruptcy is inevitable. There are also people who believe that the government should not give financial on domestic software, and other aspects of the special support.

To this, Beijing lang new TianJi software technology Co., LTD JiangJianJun President, said this in surprise. Office of the operation mode and the problems: the product is depend on the government procurement, enterprise growth depends on the support of the government. Now under the market economy condition, the software enterprise real growth to pass the baptism of the market economy, after market customer choice and eliminated, and gradually improve growth. In addition, in the innovation also not enough. The personage inside course of study expresses, the country today that there are problems, most software innovation ability is insufficient, whether office software or operating system, been in the pursuit of "Chinese independent" thing, but what do actually have not been very successful.

The Internet life of Hong Kong people - Business

People's efforts in recent months, telecom operators upgrade broadband network, 100 M frequently to 1 G across it is to let person surprised. In fact, the 1990 s, when many people still don't know what is in shenzhen, has the Internet for the general public to provide Internet service. In 2004, Internet penetration has been as high as 51%, well ahead of shenzhen.

Today, broadband network has covered all commercial buildings and more than 95% of the house, for the world, second connection speed and price has only a small percentage of shenzhen. After all, the network highly developed , people is a DotNet how life? They will also with shenzhen like people, often bubble BBS, weaving collar, shopping, go to see a movie? Their life online and what are the similarities and differences between shenzhen?

Shenzhen envy people keen on consumer cheap taobao buy

People like online shopping, in a hotel group marketing manager GuoHang friends, colleagues, relatives have the habit of e-commerce, the age from teenage students to her out of the jobs, but they way of getting a lot, not only ebay, amazon.com and local online mall outside, anyway, is the free trade port, the world's web site is the object of e-commerce. However, and most people imagine different, people's favorite unexpectedly is clean out treasure and clap.

With the advantages in shenzhen and is on to to shopping, in qiang north, who don't know "GangBan" digital products than the mainland HangHuo cheap two thirty percent? And in many people's eyes, things have not only the guarantee, and with the global synchronous, trendy stuff is the first time on the market. The people in local directly buy not to go in the mainland, why the net buys? In fact, with the people have is famous for its careful yourself a set of ideas.

GuoHang said: "every month I buy a lot of things in getting on, big to furniture, small to some jewelry, expensive may millions of dollars, cheap may be a few pieces. The past like rate of exchange, see which website the cheapest, and now has basically been touched a pattern: digital products in , the host of the website, and the most cost-effective buy parts can choose clean out treasure."

She remember last year to buy camera, a Internet mall is the price of hk $2200, she went to clean out treasure to see once, the price is 2200 yuan RMB, instead more expensive. However, the camera to buy back, she found himself also need a spare battery, she asked the businessman price, the most cheap also want more than 300 hk dollar, and on taobao, several sellers to open her less than 200 RMB, and DuoYuan brush credit card still avoid shipping costs! When receiving, she also worry is original, but to the service quality goods testing center found no problems.

She can't understand most of all, why her camera is made in the mainland, but the price difference with battery so much? And iPad is the production of foxconn, but the will than inland cheap hundreds of yuan, a lot of shenzhen's friends are let her to buy on sb's behalf, but this kind of thing was completely cover in turn.
Just arrived from university graduate WuChuChu like online buy clothes, she like Singapore's a brand, but did not store, little store style not new and price is not cheap. Once she got in central shopping a flyer in taobao, this leaflet, she saw the brand, home collided, all the latest login, the wettest style all came out, and the price is only 1/5 of the , it made her feel very surprised.

"Compared with ebay, now I prefer taobao, buy things with the seller can talk slowly, they will be very careful help you answer all the questions, the feeling is very kind. And and overseas sellers can only send mail." WuChuChu said. At the same time, although she knew that the mainland C2C mall fake across, but she feels like: "everywhere is same, can only rely on their own judgment, look more credit, see evaluation need not be afraid."

In fact, there are something attracted to the inland people online mall shopping--" from mail ". Now the mainland express up prices, even if is the shenzhen city e-commerce, 10 yuan is not out of the freight exemption, and sent to 's cross-border express but can be mailed free? According to information, shenzhen to send to freight general as long as 30 yuan, recently some bank and clean out treasure to make activities, as long as the brush credit card can have this basic freight is avoided.

In addition to shopping, now more and more people to the mainland, travel mango, electronic arts, such as dragon is also often they visit website. WuChuChu told reporters, the first nunn in lijiang is on ctrip booked inn, the first drive to hainan in mango is rented a car in the tourist site, "get up, and trouble? Or your good, often can't order".

Now the mainland web sites have started to make a conscious effort to penetrate into people's life, WuChuChu said in the central, Tsim Sha Tsui, Kowloon tong, often can see them doing publicity activities, and the service is more careful, than of the seller of the more understand people, almost people 'shelter and food can be found in all above, "often hear shenzhen friend said things cheap, they were actually body never know when they are."

Shenzhen download software swept the country people download films afraid of illegal

In the past two years, the shenzhen telecommunication, unicom, the Great Wall and so on several big broadband providers are almost will improve the speed of the broadband 2 or more times. High-speed network means sharing and spread more fluent, since the shenzhen people how the 2 M, 4 M, 6 M even 8 M broadband, movie disc slowly disappear from inside the life of people.

In shenzhen this Internet town was born the thunderbolt, fast and its QQ whirlwind and a number of China's most popular BT (or download/upload says P2P) tool. Use these tools can be easy to download and share all kinds of film and television resources, whether Hollywood or domestic, film, search, buffer for a while to be able to watch. Broadband speed greatly, make BT and movie resources on picture almost hospital.
But in , BT and the resources are a dangerous relationship, through the BT download copyright movie may bring face serious consequences. In recent years, has happened several users download/upload BT use movie was arrested and law enforcement agencies, by law of sanctions events.

In January 2005, net friend "emperor" because the following upload daredevil, the beauty of undercover ", as well as the "universe" 3 sets of deep panic without authorization of the copyright holder of a movie, and become the first to use BT and was arrested and people, the government to "a crime or not honest purpose and access to the computer", convicted of the him to jail for three months.

In August, 2006, film industry to 42 use BT download movie of the civil charges against a net friend. In April, 2009, customs announced arrested a 38 net friend, the netizens suspected to BT stage "distribution" infringing movie resources.

Two years ago, just to read a graduate student small, as his peng in the mainland, like all day in the dormitory as hanging computer download films and music. But, after discovery, roommate very solemnly remind him, this in is illegal behavior of copyright content, there are strict limit the spread of. Usually a few download/upload may not have a problem, but often a lot download/upload can have a huge flow, most likely were reported.

Although has arrested BT download, but hasn't stopped the visitors of inland, and these video web site, to have the very rich movie resources, such as thunderbolt look at, potatoes, optimal cool, etc. Now, however, the video site visit is more and more difficult, because they are in order to circumvent local copyright risk, is gradually shielding from IP. Small pan said: "every time back to shenzhen will go to buy a hard disk kao movie." It is reported, in the qiang north there are a lot of "professional hd copy" point, as long as a hard disk to, they can help you save hundreds of film, patronage their in is a life of the people.

hit an infringement, actually not only network also has been pushing the original web content, the citizens of rich life online. In 2006, for example, first the download online music charge was established, the user simply MOOV platform must pay the rent at will, can listen to all the music web site or concert, but the content can't live, can only listen to download online.

In fact, a river across shenzhen has paid much attention to the Internet copyright protection work, and will copyright industries as a pillar industry, and strategic new industry. May 13, and the seventh superiority released during the development of shenzhen copyright industry globally, said shenzhen Internet, new media industry sprung up, and a certain scale, 2009 Internet industry scale at about $22.5 billion, or of the country. At the same time, 13.4% of shenzhen copyright sector was growing rapidly, and the number of employees in 2010 shenzhen copyright sector was reached 177.123 billion yuan, a year-on-year increase of 22%.

Start end last year, shenzhen market supervision and administration in a more on television, Internet piracy works of the special control "sword nets action", the Internet company and the requirements for Internet operators "first authorized," after the spread of self-check work.

Introducing How To Download Free Movies Online - Entertainment

If you wished to to download free movies online may it be authorized or not? Which is the query many folks ask me, and all I can response is which it depends on the videos and their age. One can legally download community domain videos use document discussing operating system additionally have any idea as peer to peer or P2P operating system. It's not the operating system which's unlawful. It's which you use it for.

For example, if you use your vehicle to nationality guys on the freeway at 2 times the pace threshhold it's not the car which's unlawful, it's the way you use it. In reality, very little operating system is unlawful - it's how folks use it which can bust the law, and folks tend to use certain types of operating system much more illegally in contrast to other individuals. Document discussing is one.Why is this, and how achieves it do the job?

The why is apparent - simply because P2P operating system is very simple to use and the temptation to download copyright g uarded content is immense. The way it works is which document discussing operating system enables you to hook up to a aspect of the difficult disk of any computer in the network, and download any records on which aspect of the doorway's difficult disk.So let's say you were seeking the latest version of Titanic. You login and key in 'Titanic' into the search box.

Which should come up with a list of 7 videos beginning with the German 1943 propaganda motion picture (don't ask!) of which identify, and ending with the 1997 Kate Winslet version, simply after the (better to me) Catherine Zeta Jones 'Titanic' a 12 months earlier which didn't get the acclaim it could have received.Having said that, back again to means to download totally free videos online and the first variations of the Titanic: the 1943 version may have now been in the community domain, its copyright (50 many years) having expired. Having said that, the motion picture and audio moguls modified this to 70 many years after the demise of the originator.

Walt Walt disney world be cautious!Nevertheless, you can possible download totally free videos online if the motion picture was first launched 70 many years ago. The originator's identify might be open up to argument, but it is unlikely which anyone should follow you for downloading the first 1943 version of the Titanic: the originator of which was Goebbels, Hitler's Minister for Propaganda! It showed Americans as incompetent dummies (who ended up the dummy then!). No person should complain if you download community domain videos similar to these. In up to date days even so you can watch movies online by utilizing P2P document discussing operating system and you can additionally use a similar operating system solutions to download totally free audio procedures and totally free games.

You must guarantee which the procedures and games you download are not guarded by copyright, and the finest document discussing operating system should warn y ou once a particular motion picture document or audio monitor is guarded. The reason why folks still use this form of operating system in spite of the ext of the copyright time period is twofold:a) Due to the fact they believe which the audio and motion picture moguls are being greedy by prolonging the copyright time period to long after their own deaths which can make it following to not possible to download community domain videos any much more, andb) Due to the fact many artists, specifically the younger ones, use this class of totally free publicity to let their names and their do the job be have any idea, and whilst this applies mostly to audio, it additionally applies to the younger motion picture studios which need to come across the community's reaction to their do the job.

So they make their do the job totally free for those which need to use P2P operating system to download it.Almost nothing unlawful concerning which, and for many it works very well. When you downlo ad totally free videos online on internet TV which have been written, developed and focused by amateurs you can typically arrive in all of gems similar to The Blair Witch Undertaking and other individuals which whilst not freely available, were yet were generally downloaded which without doubt contributed to their success.

How to Find Public Domain Content - Entertainment

One of the easiest places to find authoritative public domain content is... your local used bookstore or library!True -- virtually everything contained in the books you'll find at these locations were protected by copyright. But... it's also true that many of these copyrights have expired -- making the contents of those volumes completely public domain.US copyright law has gone through several iterations -- but the two things you need to remember are "75 years from copyright date" and "Sonny Bono"!

The copyright law originally stated that a copyright would last for 75 years. Thus, if a book were copyrighted in 1900, the copyright would expire in 1975. If a book were published in 1920, the copyright would expire in 1995. If a book were copyrighted in 1922, the copyright would expire in 1997. But... if a book was copyrighted in 1923 or later, then things take on a whole new slant... courtesy of then-Congressman Sonny Bono.

You see, a particular item was originally copyrighted in 1923. It's copyright was due to expire in 1998 -- sending this item into the public domain. This is normally not a problem -- truthfully, most people don't care about things copyrighted so far back. Expiring the copyright can actually grant these works new life in the public domain. In this case, though, the item due to expire was a mouse -- Micky Mouse! Its interesting that Disney has no problem using stories that are already in the public domain Sleeping Beauty, Treasure Island, Hunchback of Notre Dame, Three Musketeers, etc, etc but theyre not too crazy about their flagship icon becoming available in the public domain.

Disney lobbied Congress heavily and Congressman Sonny Bono introduced legislation to extend copyright protection for an additional 20 years. This legislation passed in 1998 -- but only applied to items that were not yet in the public domain. Thus, an item copyrighted in 1992 was public domain after 75 years -- but anything copyrighted in or after 1923 wa s protected for 95 years. So -- to play it perfectly safe and legal -- if the copyright date on a published work is 1922 or earlier, the item is now in the public domain and may be freely used (but not necessarily re-copyrighted and sold). If the copyright date is 1923 or later, it's best to leave it alone till at least the year 2018!So what good is a book published and copyrighted prior to 1923?

Well, if it's a book of sheet music -- or a book of classic poetry, literature, or theater -- or a book of formulae, travel, or... well, you get the idea. Some things become dated -- but some things are just as current today as they were when they were originally published. This doesn't mean you can find a book by Mark Twain in the bookstore and freely copy and distribute it. You'll likely find the copyright on that published work is fairly current. However, if you find an old version of the same book published and copyrighted prior to 1923, then you can safely use it!The best places to spot these treasures -- try your local public library, used bookstores, or estate sales.

Copyright For Fashion? The discussion - Publishing - Copywriting

The copying of fashion design originals - "knocking off" or "affordable interpretation," depending on your point of view - is a practice that designers may have grudgingly accepted in the past, when less expensive copies took some time to reach stores and only those consumers who could afford the designer-label originals could be the first to follow a trend. This practice is costing designers greatly as more advanced technology makes it possible to see high-quality copies appear in stores before the original has even hit the market. While it has long been the practice of the American fashion industry to knock off European designs, American designers did not copy one another. They registered their original sketches with a trade group called the Fashion Originators Guild, an organization that urged retailers to prohibit styles known to be knockoffs.

In 1941, the Supreme Court held that the Guild was an unreasonable restraint-of-trade; the end of the Guild marked the beginning of the knocking off "free-for-all" that we are familiar with today began. It is now common for imitators to photograph the clothes in a designer's runway show, send the photo to a factory to be copied, and have a sample ready within a couple of days for retail buyers to order. Since fashion collections are displayed in runway shows approximately four to five months before they are available to the public, this leaves the fashion impersonator plenty of time to get the copies to stores at the same time, if not earlier, than the originals. Designers assert that design piracy cuts into their longstanding franchise of uniqueness, lowers their sales volume, and ultimately removes incentives for creativity.

Sometimes the same department stores that carry the higher-priced version of a garment will also sell the lower-priced knockoff, often under the store's private label. Knocking-off is widespread in the fashion industry and even those designers who fume over being copied are not above doing it themselves. Because of the speed with which designs can be recreated, it is not even always clear which designer created the original and which designer simply copied it. This discussion will explore how protection of fashion works fits - or does not fit - into the current intellectual property law framework in the United States. The overall organization of this discussion is a systematic consideration of possible protection for works of fashion under copyright, patent, and trade dress law. This discussion will encompass not only the current state of the law, but also proposals for reform, such as an amendment to the Copyright Act to protect fashion works.
The central question is whether fashion design is an art worthy of protection or a craft whose practitioners can freely copy one another. In an industry where many designers come out with similar looks each season - and where inspiration is said to be "in the air" - designers and the thriving knockoff industry are fiercely debating the issue.

Another key question: whether knockoffs actually benefit the industry as a whole. Copying, some argue, propels the fashion cycle forward by creating popular trends that encourage designers to move on to the next big idea. In what they call the "piracy paradox," law professors Kal Raustiala of the University of California, Los Angeles, and Christopher Sprigman of the University of Virginia argue that copying makes trends drench the market quickly, driving the fashion cognoscenti to search out newer looks. "If copying were illegal, the fashion cycle would occur very slowly, if at all," While they admit copying can harm individual designers, they say Congress should protect industries only when piracy stymies -- rather than encourages -- innovation.

Despite the apparent unsuitability of copyright protection to works of fashion, commentators are often confused by the anomalies in copyright law under which fashion accessories, works of architecture, and computer chip designs are eligible for copyright protection. Some argue that since copyright has already been extended to protect the aforementioned items, copyright may be the best legal tool that fashion designers have when fighting design piracy.

For example, Robert Denicola has argued that it would be more consistent with the legal principles of intellectual property law to draw the line of copyright with respect to arguably "useful articles" by shaping whether, in the process of creating the item, the designer focused primarily on aesthetic or utilitarian consideration. Such a test would to a great extent improve the odds that works of fashion would be granted copyright protection, as most fashion designers are concerned with the aesthetic rather than the functional aspects of their clothing.

The specific extension of copyright to fashion works would have many advantages for designers. First, a copyright owner may seek an injunctive remedy to prevent the impersonator of his or her design from making and selling copies of the original. Second, copyright law allows for the imposing and discarding of the infringing items. Third, the copyright owner can recover damages, either actual or statutory, and also profits. Finally, the copyright owner may be able to recover court costs and attorney's fees. This last remedy is especially important in fashion design cases, as it allows small new designers to take on big manufacturers whose greater power and financial resources would otherwise be an intractable obstacle.Despite these advantages to fashion designers, an amendment to the Copyright Act for works of fashion is not likely to be passed soon.

As one commentator concisely stated that the current situation of the legislators and courts has a great deal of trouble seei ng past the utilitarian function of a piece of clothing. While industrial designs have been the subject of repeated bills, Congress has explicitly excluded fashion works from these bills. For example, while the Design Anti-Piracy Act of 1989 would have protected original designs of useful articles against unauthorized copying, the bill would have barred apparel designs composed of three-dimensional shapes and surfaces with respect to apparel. According to one commentator, this exclusion has no basis in any discernible principle. It was added to help still the vociferous opposition of retailers to the bill." In this current climate of judicial and legislative hostility, copyright protection will probably not be extended to specifically protect fashion works.

Fashion seems to be an industry particularly ill-suited to legal restrictions against copying. Copying - or "borrowing" or "reinterpreting" - is prevalent at every level of the fashion industry. When a lower-priced designer knocks off a higher-priced designer's clothing, the copy may be a huge success because it offers more value for the price. But it is the higher-priced designers who are copying each other.
Fashion designers labors over their finished product just like any other creator or inventor. It takes hours upon hours of careful effort until a dress with just the right cut or a purse with the perfect design is complete. Why should this hard work and effort not grant the person behind the creation some level of security, allowing them to collect the benefits of their labor?

As a matter of Public policy it is generally believed that copycats are good for the economy. The claim asserts that preventing copyright for fashion eliminates the possibility of a monopoly by providing the consumer with lower priced knockoffs. Furthermore it is contended that knockoffs really promote business for the designer by creating a market for a style of fashion. But do we believe this actually? And what's wrong with having a monopoly on fashion? When a consumer spends thousands of dollars on a purse or a dress that others will recognise as a Louis Vuitton or Versace, they should be able to enjoy the exclusivity that comes with such a purchase. Knockoffs steal from the consumer of their exclusive right to enjoy a specific product.

There are policy based arguments behind the government's resistance to providing a copyright for fashion; ranging from the dislike for creation of monopolies to improving the market.

If the designer believes another person infringed his copyright, he could sue those who sell or manufacture the design in any federal court. Those found guilty would face fines of 250,000 or $5 a copy, whichever is greater.

How to Avoid a Bootleg Movie Download When You Download Free Movies Online - Entertainment

People are getting paranoid on how to avoid a bootleg movie download when they download free movies online. They can use a P2P file sharing program to download music or movies - and also games, but have read too much about it being illegal. Here are some facts on that, and how you can watch DVD movies for free without breaking a single legal statute.

It all boils down to copyright. There are two aspects of copyright: the legal and the moral aspect, so let's look at each of these in turn because most people have no idea how they are being manipulated.

Legal Aspects of a Bootleg Movie Download

A bootleg movie download is fundamentally the downloading of a movie with a valid copyright. You could safely say that, with one or two exceptions, all modern movies are copyright-protected and you would be breaking the law if you download free movies online that are so protected.

That is why the perfectly legal P2P file sharing software used for legal movie downloads can equally be used for bootleg movies and to download free movies online legally - without you being aware of the difference! In fact this type of software is becoming more commonly used to download free movies illegally than legally- but that is not the fault of the software. However, Limewire was put out of business for enabling illegal online music downloads, and so was the original version of Napster.

Social networking sites can be used to break the law and call people to riot at prearranged times and places, but that is not the fault of the software and these sites are not shut down. Why then the problems with a bootleg movie download?
The call to ban file sharing is a spurious one born of ignorance and fear. In fact, young people download free music online to get a feel for the artist before they decide to invest in the album: and quite righty too!

Many New Artists Are Talentless

In this digital age it is too easy for talentless people to digitally enhance their work and produce terrible-sounding albums fronted by one digitally-enhanced main track that has been promoted to death. The rest it sheer rubbish! Why should potential customers not be able to check out one or two more tracks on an album - digital or disk - to get a better idea of the artist's talent - or lack of it?

You can do that by using a P2P file sharing program to access and download any music or movie files stored on the hard disk of another user of that file sharing network. Is it legal to do that? Yes and no! Limewire was put out of business for enabling illegal online music downloads, and so was the original version of Napster.

Public Domain Movies

Yes, if the file being downloaded is in the public domain, such as 'The Outlaw' with Jane Russell, but not if you download free movies online that are currently showing "in a movie theater near you!" That would be referred to as a bootleg movie download, and therefore illegal. The Battle of Midway and the 1945 color version of Narnia are also free to download legally and there are many more listed online of you carry out a search for public domain movies and music.

However, that understood, there was a time that we knew the copyright period - it changes too frequently now. The Copyright Act of 1790 covered an author's work for 14 years, or 15 if he or she was still alive. Over the years this has extended to 95-120 years or life + 75 years - something that most people cannot understand.

The basic concept is fine, but the way the law is applied and continually changed is confusing - little wonder that so many download free movies online believing them to be in the public domain. It's as if people should own their own work years after they are dead. After all, Walt Disney made his billions from the works of the Brothers Grimm, Hans Christian Andersen and others.

A Legal Bootleg Movie Download

Night of The Living Dead is in the public domain because the title was changed just prior to release, and the new title was not included in the copyright notice. As soon as the movie was released, P2P file sharing could be used to download this movie without it being a bootleg movie download - it was perfectly legal. It also written in the law of America that copyright law cannot be applies retrospectively, so once copyright has lapsed then the work will be in the public domain forever.

This is not to suggest that when you download free movies online everything is free to download: far from it, but if you are using a good file sharing software service, it should let you know that there is no license to download the specific file.

To summarize, it is not easy to avoid a bootleg movie download when you download free movies online because the same software is used for each. However, it doesn't take much of a brain to understand that new movies and music are illegal to download. In saying that, it is nevertheless stressed that it is not the fault of the P2P file sharing software but that of those using it illegally.

Get Money for Creating Beats - Entertainment - Music

If you're creating beats and wondering if you can make some money off it, the answer is HELL YES you can! That's why I wrote this article. I'm gonna tell you how to create beats and be sittin' proper on some serious bank.

One thing you about creating beats and making money is you first need to realize that there is a lot of money to be made out there. Creating beats is a trade just like any other trade. Some people go to the factory, some folk go to the mic. It's all good. So respect your trade and be proud that you're the one creating beats, because not everyone can do it. And that's for real.

Pay attention to some of the rumors you probably hear about how a lot of big name artists aren't even making that much money. You may hear how they only may be getting a few cents for every album they sell. I'm gonna let you know somethin' here. The truth is that this is true for artist in many cases.

But in the music business you need to understand that the cats sittin' behind the scenes are the ones who are really bankin'. And you know who's back there behind the scenes with all the ones callin' the shots? That's right, the cats creating beats is back there. Usually the producer is the dude gettin' paid FIRST. He get paid before the beat even leaves the studio usually. Now that's tight.

Realistically, there's tons of fools out there who make a couple grand just off one beat. And I'm not talkin' about them dudes you heard of like Dre or Timbaland. I'm talking about dudes creating beats that you never have heard of and probably never will. They be gone before you even know about 'em. But that's how they do it. These cats just chill behind the scenes collectin' their checks, gettin' paid and laid, just for creating beats.

But do you think these fools just struck it rich from creating beats? No sir. You don't just walk up to Dre and hand him your beat and he be like, "Yeah, I'll peep it out later." First of all you ain't even gonna get within 50 feet of Dre without his homies all around. And second, Dre would toss your beat in the trash, son. Yeah it is possible to make your living creating beats. But first you gotta school yourself on what these cats is doin'.

So I'm gonna help you out. Here's a few spots I threw together to help cats out there who wanna be creating beats.

  • 1. If you wanna make good music you gotta know what good music really is. You gotta listen to beats before you can create beats. And I mean really listen to them. Chill out, smoke a spliff or whatever you gotta do, but sit down and chill and listen to your favorite track. But this time try and forget about the vocals, and just tune in to that beat. Beats be doin' some crazy stuff in the background of tracks, and you ain't never heard it 'cause you always listenin' to the mic. You gotta dig on the drum track by itself before you know what you doin'. Check out how the tracks is panned, what's on the left and what be on the right. Alla that shit. Dig on that hi hat, check out the effects they be usin' on voices and shit. You gotta know how to do alla that if you want to be creating beats, so you got your work cut out for ya, son.
  • 2. Cut a CD. Make a CD with some of your best beats and have them soundin' as fresh as they can. You gotta have more than about seven beats on there. Try and get 10 or more. But make sure they fresh.
  • 3. Get them joints copyrighted so them Beat Thieves don't jack your hard work. And don't think they won't hit you. They don't give a damn, they just like to steal. So get them joints copyrighted. Check for the newest info on Google because they change it all the time.
  • 4. Shoot, I shoulda put this earlier at like number 3 or maybe like number 1, 'cause this one is important. You gotta learn how to play the piano. I know it sound kinda gay, but don't sweat it. You ain't gotta get all Billy Joel on 'em and shit. Just figure out some basic shit. You want to be able to get on there and hit a couple notes and make it sound tight. But get used to fuckin' with a keyboard if you gonna be creating beats.
  • 5. Sell them beats! Some fools gonna want you to come offa them for free. Don't let these fools get in your way. Just tell 'em your time worth money, son. Now sometimes it might be a good idea to hand out your beats for free. I mean, if 50 Cent come through and asked you if he could try and rap on one of your beats, you take it no matter what, 'cause that's exposure. And exposure like that will make anyone set. So you gotta play it smart.

There's a lot to think about when you creating beats and making some money. But the hard work definitely pays off when you're makin' that money like Eddie E. So anyway, if you wanna get down on creating beats, check out Sonic Pro. It just dropped, and it's already poppin'. Get it before everyone else does.

The lawsuit is present known mobile games involving a value field one of the biggest cases, and at the same time, with the search engines about, can say much attention. But at the same time, the case in the legal dispute is larger, the two parties argue, litigation war end result how, external hard to judge.

Baidu and surface rights case

Baidu over the past few years has been praised by the copyright problem. MP3 search has around there appear a large number of litigation disputes, including both domestic many times of the holder of the prosecution, also have a few big international record company joint encirclement and suppression, which has a negative baidu wins.

But, the original of the trend of The Times, and all kinds of pressure under, baidu finally realize the MP3 business model transformation, that is, no matter from which links to third party websites, as long as it is produced listen or download, all by baidu to record companies and the holder of the songwriter pay.

The CPU alliance and baidu lawsuit, CPU alliance think users download games in the process, download web site that the secondary domain name for baidu "gdown. Baidu. Com", that is, the game exists in baidu server, baidu has from the search service providers into a content provider. But baidu think, this only for the smartphone users, in order to improve its network transmission rate and use experience and some technological measures, the so-called "cache" technology.

Baidu's the behavior, if is the "copy" and "upload" game works, based on the law of copyright infringement of copyright belongs to the plaintiff. If is the cache, it may be the grounds of.

The lyrics in baidu search results have showed the lyrics from baidu server, and that is all the lyrics and not part of the content. Therefore, zhejiang pan-asia electronic commerce Co., LTD. Was Sue baidu infringement. Baidu think this belongs to the lyrics "snapshot", also be a kind of cache technology. Final court think, will be placed in the lyrics on the server, by the user through the click search box "the lyrics" button to users with the way of the lyrics of behavior, belong to "copy" and "upload" a work of behavior, the lyrics "snapshot" service is not only to search engine service, have formed around the Internet works behavior.

Even if such as baidu said the offer is "cache", but there is no indication of the process in the download the source of mobile games web site, did not give users access to source the opportunity to website, cause damage to the source of the alternative site.

In the copyright domain, providing search services should follow one important principle is "search but not alternative". So, the lawsuit, baidu faces the first of the key problems is how to persuade the court the offer is cache, is the search service, but not on the cell phone game works to copy and spread.

4 Reasons Poor Man's Copyright Does Not Protect Copyright for Lyrics - Entertainment - Music

Song lyrics are protectable under copyright law and can be registered as a "Literary Work". While lyrics are not required to be registered to attain the protection copyright laws grants, it's certainly recommended to register your work with a 3rd party to increase proof that you are the owner of your work.

One known method to protect copyright for lyricists is "poor man's copyright". What this means is the author of the lyrics would try to protect them by sending registered mail containing the lyrics to themselves.
To break it down further, the method would be: create original song lyrics; place these lyrics in a fixed/tangible form (i.e. write them on paper, type them and save them on a hard drive); put the final lyrics in a sealed envelope; send them to yourself using registered mail.

Regrettably and counter to the popular belief, poor man's copyright is not a reputable method to copyright register your lyrics and is not recognized by the courts of law as evidence to prove ownership of the work. As such, it is not a recommended method to protect copyright, especially the copyright of your valuable song lyrics.

Why isn't poor man's copyright an adequate form of copyright registration for your lyrics? Well, there are actually a number of reasons:
1. You could mail yourself a number of unsealed envelopes to attain the valuable date-stamp on each one. Then, when you have finished your lyrics, you could put them into the envelope and seal it. In other words, you would be trying to register a song for a date that is prior than the actual creation.

2. A further method of tampering with the copyright registration is sending yourself a sealed envelope with your lyrics already included. Then, if amendments are made to the lyrics, you could steam the envelope seal open and insert the updated version of the work.

3. The post offices do not consider themselves to be copyright registries and do not accumulate or store the information required by the courts to prove ownership of the lyrics.

4. Additionally, post offices do not keep reports of the registered mail for very long periods of time. Should someone copy your work in four years, it is unlikely the post office will have a record of when you sent your lyrics. Thus, it could be very difficult to prove whether you really sent the envelope through registered mail or whether the stamps were phony.

As outlined in the four reasons above, "poor man's copyright" is not a valid resource to protect copyright of your lyrics.

Fortunately, there are many copyright registries available to protect your songs, whether it's through online registries, the government, or associations. Do your research and chose the one that best suits your needs.

From 1999 the snow village "northeast all live thunder feng", China's network began to music through more than 10 years of development has become a People's Daily life is a very popular culture content. Internet music not only increased music mode of transmission of diversity, but also changed the music culture development mode, affect the music market consumer behavior. But since, China's network music market has always be in not hit of the state gave embarrassing. Although a large number of users, but because DaoLian piracy seriously, excellent network music content supply as well as standard, relative lack of clear, mature business model difficulty in forming the music web site late, and musicians to trying to get just reward and rights is brutally hard.

Network music market how to regulate? How in the industry under the condition of nearly depression as soon as possible a explore the effective commercial mode?

June 8, in order to common interests and industry development and prosperity of the benign many domestic famous record companies and music web site representatives in the network music department of the ministry of culture coordination sit to together, and in ShiChangSi ministry of culture, under the guidance of sponsored by common network music industry development league a pre-contract agreement. A rolling stone gathers mobile, ocean butterfly music and record company, sina, baidu, tencent 13 websites and mobile operators as one of the first three league member unit, the common sign the "network music industry development declaration," promises to work together to promote the industry of the original, and through the active coordination and communication, and build a reasonable content license mode, product pricing model and distribution of interests, and promote the healthy development of industry organization.Copyright protection value back.

360 million-this is in 2010, music online user, the overall size of every five in the netizen has 4 is network music users. For any musician is concerned, it is a more muffled big cake. But looking at the big cake but eat a few mouth, some even didn't smell like, really also makes many people depressed. According to the ministry of culture of the 2010 issued by China's network music market of the annual report shows that in 2010, the copyright problem is still bothers Chinese network music development of the most major problem.

Widespread piracy led to the music on the Internet of the business model of a single, profit difficulties; On the other hand, also further the free use Internet users indulge network music resource spending habits. "Every year 95% of billions of times online download is a pirate edition, final result is no stronger than its weakest link." About the damage to the industry, piracy huge whale music CEO ChenGe some helpless.
Because of piracy, network music as common network culture industry of the most frequently used form of original music, but creator and original music work was to drop, many music creators have turned in the film or other industries. The record company infringement and piracy influence by that input and output is out of the original published a new song, cause quantity decreasing year by year.

"Once a year of more than yuan of album sales decline to have now with 130 million yuan last year." As a network music content provider the representative, the sea butterfly music, music company CEO LuJian says now the biggest wish is to continue to live. "The copyright problem is solved, the development of the industry opportunities will be limited." Vice President XieGuoMin sina.com said.

To combat piracy, improve market environment, in recent years, the ministry of culture have also increased the music market regulation of network of strength. 2010 years has shut down more than 300 home without approval in the music business network without music web site, the exposure and control a group of illegal enterprise and products. 1 this year, issued the clear about illegal music products of the announcement of the network, the first of 100 without censors or record of illegal network music products to clean up renovation. April, ministry of culture and the issued about again illegal Internet culture activities of 12 of the notice on the administrative department, asking local culture and cultural market comprehensive law enforcement agencies to 14 suspected illegal house music web site inspected and network in time.

A series of measures for the implementation of the ministry of culture, cultural ShiChangSi officials said, is "to the music for the outstanding pro vide fair and open platform, encourage the creation and dissemination of excellent works". "The government to combat piracy, improve industry environment of determination and move exciting, in fact, these measures also makes some new capital and talent began to enter the industry." ChenGe think, and establish a good living environment, make excellent original network music works continuously emerging, can promote the whole network music industry's real prosperity. Expand business model to do a big cake.

And the piracy problem also seriously restrict domestic network music of the development of the market another problem is a single business model. The day's union meeting, participants who thinks generally, in actively cooperate with the government in promoting industry environment, the perfect at the same time, to the music industry will network cake, expand diversity and sustainable development of the business model is indispensable. "A single lasted for a long time to download mode has been difficult to adapt to the development of new technology, industry development of diversified e. business model and development model."

ChenGe think that the current network music industry may have 3 kinds of profit model, the first is the traditional wireless music's revenue, for example, mobile games at around wireless mobile Internet applications of all products. The second is based on the traditional PC Internet advertising model, music as the new media network, get advertising revenue. "Don't complain about advertising to make money, the American MTV sets to every year of the great advertising revenue." ChenGe introduction of the third profit model from music class game, in essence or music video, download, search, share, just set a game's hat.

According to he revealed, huge whale is currently do such things, and will consider this business delivery to many in the service of the terminal. XieGuoMin music industry is hope that through network development league, through the joint efforts of the new business model development, the user's consumption habits CongMian back to pay up the first channel. According to introducing, at present foreign successful online music sales comparison model basically has 3 kinds: single point, online booking and appreciate. Single point mode that users like which song buy what song; Reservation mode is the users to pay per month on, can download a certain number of songs; Online appreciate mode that users to pay a monthly fee, can enjoy all the songs online, download will need to pay extra. "China's Internet users base, if can solve the problem of piracy, and find the effective commercial mode, five years of domestic music network market scale do 50 billion yuan is no problem." XieGuoMin forecast said.

Strengthen the communication points good cake

In fact, the representative content provider of the record company and representatives of the music web site, channel party and operators can seek common development event, in many eyes is not easy. And it is reported, in order to extend this a few party has many contradictions of enterprise polymerization calmly discuss the problem with the ministry of culture, the cultural ShiChangSi do a lot and work, "open before and after numerous meeting at which industry chain represent different interests of party members had a very intense communication, eventually will reach a consensus, very not easy." A person in charge of the record company said, especially to help make music industry development of network alliance was established, the second half of 2010, the ministry of culture had to DuoCi will network music content provider and release channel party about together, carries on a series of negotiating and preparation.

Los Angeles Patents,Trademarks and Copyrights Lawyer Referral 661-310-7999

Copyright infringement

The following information regarding Patents, Trademarks and Copyright is brought to you as a public service of 1000Attorneys.com - State Bar Approved Lawyer Referral and Information Service. The material presented is general legal information intended to alert you to possible legal problems and solutions.

Patents are intended to protect inventions of a functional or design nature. Trademarks provide protection for indicators of the source of products and services used in commercial trade, such as words or logos. Copyrights provide protection for literary and artistic expressions. Patents, trademarks and copyrights are collectively referred to as intellectual property.

Patents are granted by the federal government to protect inventions for a limited period of time. There are three types of patents: utility patents, design patents, and plant patents. A utility patent gives the patent holder the right to exclude others from making, u sing, importing, offering to sell and selling his or her invention for a period of 20 years from the date of filing a patent application. A utility patent may be obtained for processes, machines, articles of manufacture, or compositions of matter if the invention meets three basic criteria. (1) It must be useful; (2) it must be novel, in that it has not been previously known by others; and (3) it must be sufficiently different from what was previously known that it would not be obvious to someone having ordinary skill in that field.
Design patents are available for new and original ornamental designs for an article of manufacture. A design patent protects the design for 14 years from the grant of the patent. Plant patents may be obtained for certain types of asexually reproduced plants that do not occur naturally, for example, new varieties of roses.

An inventor may prepare and file a patent application directly with the U.S. Patent and Trademark Office. However, the availability and scope of protection depend on how a patent application is prepared, so it is recommended that an inventor first consult a registered patent attorney or agent.

At the outset, the attorney or agent may suggest that a novelty search be performed to see if a similar invention has been described in a previously issued patented. If an invention appears to be sufficiently different from what is known to exist, he or she can prepare the necessary papers to apply for a patent.

Utility patent applications include a detailed description and drawings of the invention, as well as claims that legally define what protection is requested. It is possible to file a temporary application, referred to as a provisional application, before filing a regular utility application. A provisional application also must have a detailed description and drawings of the invention, but is not examined. A regular utility patent application that is filed within one year of the provisional application will be treated as though it was filed when the provisional application was filed. A patent attorney or agent can inform you of the advantages and disadvantages of filing a provisional application.

There are strict statutory requirements in the United States regarding the time within which a patent application must be filed after an invention has been publicly used, or sold, or offered for sale. It is important that an inventor be prompt in seeking help in protecting his or her invention. If your invention has been in public use, offered for sale, sold or otherwise commercialized for more than one year before your patent application is filed, the inventor is barred from obtaining a patent in the U.S. unless the inventor can show that the public use was primarily experimental. Other countries have different bars, which are generally much more strict than those in the U.S., so it is best to consult a patent attorney o r agent before you do anything to commercialize your invention or disclose it to others.

The words "patent applied for" or "patent pending" mean that an application has been filed in the U.S. Patent and Trademark Office. Such notices create no legal rights, however, as patent rights are created when the patent is granted.
A United States patent provides no protection in foreign countries; however, filing a patent application in the United States prior to any non-confidential disclosure of the invention will temporarily preserve the inventor's rights in most foreign countries, so long as applications are filed in those countries within one year after the U.S. filing date. However, so long as inventions are kept confidential, applications can be filed in other countries at any time.
A patent is a property right that may be held for one's own use, sold outright to another, or licensed to others.

After a patent is issued, the federal government does not police the market for violations or infringements. If others infringe the patent, it is up to the patent owner to assert his or her rights.

A trademark is a word, a name, a symbol, a device, a combination of these, or other indicator used exclusively to identify the source of products and distinguish them from oth ers. Examples are "Kodak" for cameras, and "Chevrolet" for automobiles. Service marks are like trademarks, except that they identify services. Examples of these would be "McDonald's" for restaurants, and "Holiday Inn" for motels.

There is a hierarchy of protection for trademarks and service marks. The strongest are coined or arbitrary marks that in no way suggest or describe the product or service. An example is "Kodak" which was a coined or made-up word when first adopted.

Next, and also protectable, are marks that merely suggest the product or service or suggest some characteristic or quality of the product or service.
At the bottom of the list, and generally not protectable, are descriptive marks. Generic terms can never become valid trademarks.

Rights in a trademark or service mark are acquired in the United States by being the first to use the mark in commerce on or in connection with the goods or services. Rights also may b e established by filing an application for trademark registration in the U.S. Patent and Trademark Office based on a bona fide intention to use a mark at a later date. A mark is not registered until it has actually been used on a product or service.

It is not necessary to register a trade or service mark. It can be protected under state and federal laws without registration. However, it is beneficial to register the mark, either with the Oregon Secretary of State, or if interstate commerce is involved, with the U.S. Patent and Trademark Office.
When a mark is registered, particularly at the federal level, the registration provides to others notice of the registrant's claim of ownership, and it gives federal courts jurisdiction to hear infringement claims. Once a trademark is registered with the U.S. Patent and Trademark Office, it may be accompanied by an "R" in a circle, or by some other notice indicating that it is registered in the U.S. Patent and Trad emark Office.

Before you adopt a mark for use on either a product or service, you should have a search performedto determine if someone else has previously established rights in the same or a similar mark. Again, an attorney may be helpful to you in making such searches before you adopt a mark and in later registering your mark.

Additional information on patents and trademarks is also available at the web site of the U.S. Patent and Trademark Office, www.uspto.gov.

Copyrights seek to promote literary and artistic creativity by protecting what the U.S. Constitution broadly calls "writings of authors". Copyrightable works include literary works, musical and dramatic works, sculptures, motion pictures and other audio-visual works, sound recordings and computer programs.
A copyright protects only the particular expressions of ideas and not the ideas themselves. To be protectable, a work must be original and it must evidence some crea tivity. Depending on the nature of the work, the owner of copyright has the exclusive right to reproduce the work, to prepare derivative works, to distribute copies of the work, to perform the work, to display the work, and to authorize others to do these things.

Once a copyrightable work has been created and fixed in a tangible form, such as being written down or recorded, it is protectable, whether it has been published or not. If it is to be published, all copies of the work that are published should preferably bear a copyright notice. The statutory copyright notice consists of the symbol of a "C" in a circle or the word "copyright," the year of first publication, and the name of the owner of the copyright. In the case of sound recordings, a "P" in a circle must be used in place of the "C" in a circle. Audio-visual works should bear both the circle "P" and circle "C" indicators.

Copyrights may be registered with the Copyright Office in the Librar y of Congress. As of 1989, it is no longer necessary to place a copyright notice on a work, nor is it a requirement to apply for registration with the Library of Congress, but such notices and filings are strongly recommended to obtain advantages in the event that a copyright is to be enforced in a court of law. For example, registration is still to bring a lawsuit, and the existence of a registration prior to an infringing act may entitle the copyright owner to additional monetary awards by a court.

An individual's copyright lasts for the author's lifetime plus 70 years. A copyright registered anonymously, under a pseudonym or as an entity lasts 120 years from creation or 95 years from the date it is first published, whichever expires first.
