In response, China's major video-hosting websites, including Youku.com, Tudou.com and Ku6.com, removed unauthorized foreign TV series videos.

A podcastor, using an online name "Xueselaoxie" on the Nasdaq-listed Youku.com, said some 7,000 unauthorized videos of American TV series he had uploaded were deleted by the website in one night.

To fans of foreign TV series, the ban might be a nightmare. But to the country, it was an important step in fighting IPRS infringement, said Li Yongqiang, assistant to CEO of Beijing Baofeng Inc., a provider of online video-hosting service.

Similar regulations were issued earlier. But never had they received as many reactions as did this one, Li said.

"I checked some portals after the ban became effective. Some websites removed all the unauthorized videos of American TV series in just one night," Li said.

"I believe the entire online video-sharing industry had realized the importance of a healthy development environment, and people's awareness of IPRS will be raised," Li said.

Following the order from the central government, many provinces beefed up their efforts in cracking down on online IPRS infringement.

In northeast China's Jilin Province, the provincial copyright administration shut down two websites, o2sky.com and imdj.net, after they were found illegally providing unauthorized videos of South Korean movies.

The ban has resulted in a reshuffle of online video-sharing industry in China, with major domestic websites gearing up to offer copyrighted imports of and films.

Sohu TV offered many copyrighted online videos of American TV series, including Gossip Girl, the Big Bang Theory and Nikita, after signing agreements with Warner Bros..

Youku.com signed agreements with three major South Korean TV stations - MBC, KBS and SBS. It has also purchased rights from Warner Bros. to stream the hit movie "Inception," and charged five yuan (about 75 U.S. cents) for each view.

Don't Be Fooled By The Lack of a Copyright Notice

We are all familiar with copyright notices. They appear on web sites, compact discs, books, virtually everything that is protected by copyright laws.

They usually contain the letter "c" inside of a circle with wording such as "All Rights Reserved" following. Even though most everyone is familiar with these notices, there is a great deal of confusion about the purpose of a copyright notice and what the failure to include such a notice may mean to the author of a work. Much of this confusion arises from a relatively recent change in United States Copyright Law.

Under past United States Copyright Law, it was necessary to place the copyright notice on every item containing a protected work. Failure to include a copyright notice on a substantial number of published items could lead to loss of copyright protection. In effect, the work would lapse into the public domain because the failure to include a copyright notice was deemed to be a waiver of copyright protection. About 15 years ago, the United States amended the copyright laws to come into conformance with the Berne Convention on International Copyrights and the laws of many foreign countries. The end result is that failure to include a copyright notice on a published work does not any longer lead to loss of copyright protection.

Even with this change of law, there are still very good reasons to include a copyright notice when you publish a work of original authorship. including the notice asserts to the world that the work is yours and that you intend to enforce your rights. It also helps guard against a defense of innocent infringement or an arguement that the infringement was not intentional. Under the copyright laws, intentional infringement results in much higher statutory penalties.

The end result of this change in law is that it is no longer safe to assume that a work that does not include a copyright notice is not protected under the copyright laws. The copyright laws protect all original works of authorship regardless of whether they contain copyright notices or have been registered with the copyright office. There can be differences in the level of damages available if a notice is not included or a registration has not been affected. Still, misappropriation of a work of original work of authorship is still considered copyright infringements and damages would be recoverable against hte misappropriating party.

Given this fact, it is wise to assume that everything you run across on the Internet is copyright protected. You should refrain from publishing or using these items unless you obtain a license from the author. If you cannot find out who the author is so not assume that they are not out there and will not come after you if you use their material. The inconvenience and potential legal liability are too substantial and could have huge adverse impacts on your business.

File sharing is the practice of distributing or providing access to digitally stored information, such as computer programs, multi-media (audio, video), documents, or electronic books. The Digital Economy Act is designed to protect online businesses, and breaches of these regulations therefore arise where loss of revenues could result from copyrighted material being made freely available rather than purchased from internet retailers. This act includes various sections to tackle illegal file-sharing including a so-called "three strikes" element, which would see persistent pirates cut off from the net. It also includes elements that would give courts the power to block websites that facilitate copyright infringement. Online Companies such as British Telecom, Google and Facebook have considerable opposition to this Act from firms such as, which say that elements of the bill could undermine free speech on the net without reducing copyright infringement. Another aspect of the Digital Economy Act which may have an effect on file sharing is that the onus is now on large ISPs to identify those who may be partaking in illegal downloading and take action against them. It has yet to be seen what effect this will have on the illegal file sharing scene.

Most ISPs consider that illicit file sharing to acquire content that is usually required to be paid for but can be given for free is bad. The survey found that 45% of adults aged 16-24 believed that downloading music and films from file-sharing sites should be legal. Only 39% said it should be illegal, while 16% said they didn't know. Howe ver, they were the only age group to hold such a liberal attitude to media downloads. Overall, 47% of adults agreed file-sharing should be illegal, with 29% claiming that it shouldn't be against the law. The 55-64 age group was the most conservative, with 57% claiming that file-sharing should be off limits, and only 16% believing it should be within the law.

Other issues discussed in the nature of illegal file sharing is whether discouragement of piracy should be increase. Currently it is a civil offence but should it be a criminal offence. "Sending someone to prison for downloading doesn't get around the problems: people will find different ways of doing it," says Heaney. "There's also a risk of catching innocent people." Only until the original creator steps in and files a violation claim can justice be done.

However, making a claim will not always solve the problem, as courts look at many factors in a case by case basis. These factors include, but are not limited to, the following:

First, has copyright infringement actually occurred? Is this a real violation of a copyrightable expression? Is this expression tangible? Evidence for this must be demonstrated in federal court.

Second, is the copyright officially registered? Even though your work is automatically copyrighted, officially registering the expression (a modest fee payable to the library of congress) will go a long way in a court battle and may help recover some court costs.

Third, is the claim of copyright infringement really reasonable? Sometimes courts will throw out claims where copyright infringement is unrelated to the business or purposes of the creator or reportable to the public through the press, or being used in important research.

Fourth (and as amusing as this may seem), did the original creator ever ask the infringer to stop infringing? Sometimes a simple gesture can go a long way in the eyes of a reasonable court in an overly-litigious society.

But what of the hapless entrepreneur (awash in a sea of good ideas which arent his own) who cant seem to think of an original, tangible expression to get his venture going? The best advice of intellectual property aficionados would be to ask the original creator if his/her idea may be used. Most times, a mutually beneficial compromise can be worked out and no legal actions need occur.

I have always been interested in do it yourself plans and worked upon searching for these. Before the internet was commonly used, I searched books and magazines for the same.
